Terms of Service
Welcome to NE8XT. By using our services, platforms, or AI assistants (integrated via WhatsApp, Facebook, or web), you agree to be bound by these Terms of Service. Please read them carefully.
1. Description of Service
NE8XT provides AI-powered automated assistants designed to help Moroccan businesses handle FAQs, client communication, and appointment scheduling in Darija, French, and English.
2. AI Disclaimer (No Liability for AI Mistakes)
Our assistants are powered by advanced Large Language Models (LLMs) and voice processing tools. You acknowledge and agree that:
- Evolving Technology: AI is an evolving technology and can occasionally generate inaccurate information, translation errors in local dialects (such as Darija), or scheduling overlaps ("hallucinations").
- Client Responsibility: NE8XT acts as a tool. The Business Client is solely responsible for verifying important business information, final booking schedules, and pricing.
- No Indirect Liability: NE8XT is not liable for any direct or indirect business losses, lost revenue, or customer relationship issues resulting from an error made by the AI.
3. User Obligations & Permitted Use
You agree not to use our AI assistants to:
- Send spam, abusive, or unsolicited promotional messages.
- Collect user data without proper consent.
- Attempt to bypass, hack, or overload our API integrations (including WhatsApp, Facebook, Vapi, or n8n).
4. Billing, Subscriptions, and Merchant of Record
All online payments, subscriptions, and invoicing for NE8XT products, add-ons, and usage fees are processed by Polar Software, Inc. (“Polar”), acting as our official legal Merchant of Record (MoR).
Polar is legally responsible for order processing, billing inquiries, global sales tax and VAT calculations/remittance, and dispute/chargeback management. By purchasing a subscription or initiating a payment transaction on NE8XT, you explicitly agree to Polar’s Checkout Buyer Terms and conditions.
5. Cancellation & Refund Policy
Subscription Cancellation
You may cancel your active subscription at any time directly through your self-serve customer billing portal or by emailing support@ne8xt.com.
Effective Date of Cancellation: When you request a cancellation, your cancellation takes effect at the beginning of the next month / next billing cycle. Your access, AI agents, and platform integrations will remain fully operational until the end of your current paid billing cycle. You will not be billed again for the following month.
Strict No-Refund Policy
Because our services involve immediate automated provisioning of dedicated server infrastructure, pre-allocated API quotas, and real-time LLM compute processing costs that are irrevocably incurred upon activation, all purchases and subscription fees are non-refundable.
No refunds (whether partial, full, or prorated) are issued for the current month or elapsed billing periods. If you cancel your subscription mid-cycle, you will not receive a refund or credit for any unused portion of the current month.

6. Governing Law & Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent commercial courts in Morocco, without prejudice to non-waivable consumer protection rights under applicable local laws.
